LIMITED LIABILITY COMPANY "MARIA" (hereinafter referred to as the "Hotel" or "BANKHOTEL"), represented by its Director Taras Romanovych Kuzyk, acting on the basis of the Articles of Association, and guided by Articles 633 and 634 of the Civil Code of Ukraine, offers an unlimited number of persons to receive hotel services (basic and additional) in accordance with the provisions of these Terms and Conditions (hereinafter referred to as the "Agreement").
Please read these Terms and Conditions carefully. If you disagree with any provision, or if any provision is unclear to you, we invite you to contact BANKHOTEL staff for further clarification.
By accepting these Terms and Conditions, you confirm that you fully understand all provisions herein, accept them in full and unconditionally, and undertake to comply with them strictly.
These Terms and Conditions, together with the Hotel Guest Rules of BANKHOTEL, define the rights, obligations, and liability of BANKHOTEL and the Guest, and operate simultaneously, complementing each other.
By accepting these Terms and Conditions, you confirm your consent to the Hotel Guest Rules of BANKHOTEL (hereinafter referred to as the "Rules") and guarantee compliance with these Rules by yourself and by all persons accompanying you at BANKHOTEL.
Hotel services are provided by LIMITED LIABILITY COMPANY "MARIA" (EDRPOU code: 31925346).
Location and address of hotel service provision: BANKHOTEL, located at: 8 Lystopadovoho Chynu Street, Lviv, Lviv District, Lviv Oblast, Ukraine.
BANKHOTEL features 100 rooms of various categories, a restaurant, a lobby bar, a wine bar, conference halls, a beauty salon, saunas, a fitness room, and a shelter.
1. DEFINITIONS
1.1. Agreement — these Terms and Conditions governing the provision of hotel services, which establish uniform conditions of service for all Guests under a public offer from the moment of its acceptance by the Guest. BANKHOTEL shall not give preference to one Guest over another in concluding this Agreement, unless otherwise provided by the applicable legislation of Ukraine.
1.2. Public Offer — a proposal by BANKHOTEL, addressed to any natural and/or legal person in accordance with Article 641 of the Civil Code of Ukraine, to enter into an agreement on the terms set out herein.
1.3. Acceptance — the Guest's full and unconditional agreement to BANKHOTEL's offer to enter into the Agreement on the terms set out in the public offer, expressed through payment for the ordered hotel services.
1.4. Guest — a natural person who purchases, orders, uses, or intends to purchase or order hotel services for personal needs.
1.5. Booking Party — a natural or legal person, including a travel operator, who enters into the relevant agreement for hotel services on behalf of and for the benefit of the Guest, and makes payment under this Agreement.
1.6. Hotel Service — the activity of BANKHOTEL in accommodating the Guest by providing a hotel room (bed space) for temporary residence in accordance with the booking, as well as other activities related to the organization of the Guest's stay. Hotel services consist of basic and additional services.
1.7. Basic Hotel Services — services of BANKHOTEL included in the room rate and provided to the Guest under the Agreement.
1.8. Additional Hotel Services — services of BANKHOTEL not included in the basic hotel services, ordered and paid for separately by the Guest.
1.9. Room — a separate furnished space consisting of one or more rooms equipped for temporary residence.
1.10. Bed Space — a portion of the room's area with a bed, bed linen, towels, and other amenities in accordance with the hotel's category, designated and suitable for one person's accommodation.
1.11. Penalties — a fine payable by a party in the event of a breach of the requirements stipulated by the Agreement, the Hotel Guest Rules of BANKHOTEL, and/or applicable legislation of Ukraine.
1.12. Booking — the process by which the Booking Party (Guest) reserves basic and/or additional hotel services for use within agreed dates by a specific Guest or group of Guests.
1.13. Booking Confirmation — the Hotel's agreement to fulfill the ordered list of basic and additional services in accordance with the booking request.
1.14. Booking Request — an official submission by the Guest containing a request to book hotel services at BANKHOTEL.
1.15. Guaranteed Booking — a booking secured by advance payment for services.
1.16. Non-Guaranteed Booking — a reservation without advance payment, subject to room availability upon check-in at BANKHOTEL.
1.17. Cancellation — the Guest's refusal of a confirmed booking or any modification thereof. In the event of a late cancellation or no-show, BANKHOTEL will charge a cancellation fee in accordance with the terms set out in the Hotel Guest Rules and this Agreement.
1.18. Free Cancellation — the Guest's cancellation of a confirmed booking under the terms provided by this Agreement, made no later than 24 (twenty-four) hours before the scheduled check-in date.
1.19. Late Cancellation / No-Show — the actual failure of the Guest or a group of Guests to arrive at BANKHOTEL on the check-in date, or cancellation of a confirmed booking less than 24 hours before the stated check-in date.
1.20. Check-In Date — the date of the Guest's arrival at BANKHOTEL.
1.21. Check-Out Date — the date of the Guest's departure from BANKHOTEL.
1.22. Early Check-In — the Guest's arrival at BANKHOTEL before the standard check-in time.
1.23. Late Check-Out — the Guest's departure from BANKHOTEL after the standard check-out time on the day of departure.
1.24. Standard Check-In/Check-Out Time — the time established by BANKHOTEL by which the Guest must vacate the room on the day of departure, and after which check-in at BANKHOTEL is available.
1.25. Hotel Guest Rules — rules developed by BANKHOTEL that apply to all Guests, govern the relationship between Guests and the Hotel, and set out the basic requirements for staying at BANKHOTEL. Repeated violation of the Hotel Guest Rules entitles BANKHOTEL to terminate this Agreement early and unilaterally.
1.26. All other terms used in this Agreement shall have the meanings assigned to them by the applicable legislation of Ukraine.
2. GENERAL PROVISIONS
2.1. This Agreement constitutes an official public offer addressed to any person (hereinafter referred to as "User", "Client", "Booking Party", "Guest", or "Guests") to enter into an agreement for the provision of accommodation services (provision of a room or bed space for temporary residence) on the terms set out herein, in accordance with Article 641 of the Civil Code of Ukraine.
2.2. Throughout this Agreement, BANKHOTEL and the Guest are collectively referred to as the "Parties", and each individually as a "Party".
2.3. Each Party warrants to the other that it possesses all rights and authority necessary and sufficient to enter into and perform this Agreement.
2.4. All terms of this Agreement are binding on all Parties.
2.5. If the Guest does not agree with these Terms and Conditions, they have the right to decline to make a booking. By completing a booking, the Guest confirms their acceptance of all terms of this Agreement and the Hotel Guest Rules of BANKHOTEL.
2.6. This Agreement is concluded by the Guest's consent to accept the Agreement in its entirety, without the Parties signing a written copy. This Agreement has legal force in accordance with Article 633 of the Civil Code of Ukraine and is equivalent to a signed agreement.
2.7. The Guest consents to the disclosure of information arising in connection with the performance of this Agreement and the receipt of hotel services from BANKHOTEL to third parties where required.
2.8. The Guest undertakes to provide accurate and truthful personal data when registering to receive hotel services at BANKHOTEL.
3. SUBJECT MATTER
3.1. The subject matter of this Agreement is the provision by BANKHOTEL to the Guest, for a fee, of hotel and additional services by way of providing a hotel room for temporary residence at the address specified herein, in accordance with the booking.
4. ACCEPTANCE
4.1. Full and unconditional acceptance of these Terms and Conditions is confirmed by the Guest's payment for the ordered hotel and additional services.
4.2. The Agreement is deemed concluded from the moment the Guest's payment for the ordered hotel services is credited to BANKHOTEL's bank account or received at its cash desk (Article 642 of the Civil Code of Ukraine), without the Parties signing a written copy.
4.3. By making payment, the Guest agrees to comply with these Terms and Conditions and to receive hotel services under the conditions established by BANKHOTEL.
4.4. By entering into this Agreement, the Guest automatically agrees to the provisions of these Terms and Conditions, the Hotel Guest Rules of BANKHOTEL, and any other terms of service published on the BANKHOTEL website and at the hotel reception.
4.5. These Terms and Conditions remain open for acceptance indefinitely.
5. DURATION OF STAY
5.1. Upon expiry of the paid accommodation period, the Guest must vacate the room and remove all personal belongings and luggage no later than 12:00 (noon) local time on the last paid day of stay, or pay for an extension of the stay, provided the room has not been booked by another party.
5.2. Extension of stay at BANKHOTEL is subject to room availability. In the event of an extended stay, the Guest must pay 100% of the room rate for the additional period in advance.
6. BOOKING AND CHECK-IN PROCEDURE
6.1. Accommodation at BANKHOTEL is provided on a prepaid basis. Upon arrival, the Guest must present a valid identity document at the hotel reception and complete a registration card. In the absence of a valid identity document, the Guest acknowledges the right of BANKHOTEL reception staff to refuse check-in.
6.2. The booking and check-in procedure is governed by the Hotel Guest Rules of BANKHOTEL.
7. RATES AND PAYMENT
7.1. All hotel services, including additional services, are provided on a paid basis in accordance with the rates and prices published on the BANKHOTEL website and at the hotel reception. Rates and the list of services are determined and amended solely at the discretion of BANKHOTEL management.
7.2. BANKHOTEL reserves the right to apply flexible pricing and promotional discounts for all services, with the exception of those subject to government price regulation.
7.3. BANKHOTEL offers a corporate and loyalty discount programme, the terms of which are determined individually by the BANKHOTEL management.
7.4. All payments under this Agreement are made in the national currency of Ukraine (UAH).
7.5. Payments may be made in cash, by credit/debit card, or by bank transfer.
7.6. The total cost of services is determined by BANKHOTEL in accordance with the booking details, including room category, number of rooms, extra beds, and other factors.
7.7. Access to hotel services is granted upon full payment. Payment for hotel services is collected in advance, no later than the standard check-out time established at BANKHOTEL.
8. CANCELLATION POLICY AND EARLY TERMINATION
8.1. The Guest has the right to terminate this Agreement at any time, subject to payment for services already rendered by the Hotel.
8.2. In the event of cancellation less than 24 hours before the scheduled check-in date (late cancellation), BANKHOTEL reserves the right to charge a cancellation fee equal to 100% (one hundred percent) of the booking value for 1 (one) night.
8.3. In the event of a no-show, BANKHOTEL reserves the right to charge a fee equal to 100% (one hundred percent) of the booking value for 1 (one) night.
8.4. BANKHOTEL reserves the right to terminate this Agreement and require the Guest to vacate the premises at any time if the Guest:
- violates these Terms and Conditions;
- violates the Hotel Guest Rules of BANKHOTEL;
- disturbs public order;
- disturbs the peace between 23:00 and 07:00.
8.5. If the Agreement is terminated due to the Guest's fault, no refund will be issued.
8.6. If the Guest is absent from the room for more than 1 (one) day beyond their check-out time and cannot be reached, BANKHOTEL reserves the right to form a committee, inventory the belongings in the room, and transfer them to a storage room for safekeeping.
9. GUEST RIGHTS AND OBLIGATIONS
9.1. The Guest is obliged to:
9.1.1. Comply with these Terms and Conditions, the Hotel Guest Rules of BANKHOTEL, and any other internal regulations published on the BANKHOTEL website and at the hotel reception.
9.1.2. Respect the rights of other guests, employees, and visitors of BANKHOTEL.
9.1.3. Observe standards of conduct and refrain from using offensive language in the public areas of BANKHOTEL.
9.1.4. Comply with fire safety regulations and use electrical appliances and hotel equipment responsibly.
9.1.5. Inspect the room upon check-in and notify BANKHOTEL of any deficiencies within one hour of arrival. Failure to report deficiencies within this timeframe will result in the Guest bearing responsibility for them in accordance with this Agreement, the Hotel Guest Rules, and applicable legislation.
9.1.6. Fulfill all other obligations set out in this Agreement, the Hotel Guest Rules of BANKHOTEL, and applicable legislation of Ukraine.
9.2. The Guest has the right to:
9.2.1. Receive full and accurate information about the rates for basic and additional hotel services available at BANKHOTEL.
9.2.2. Receive services of the quality and type specified in their booking.
10. HOTEL RIGHTS AND OBLIGATIONS
10.1. The Hotel is obliged to:
10.1.1. Provide the Guest with all paid services in a timely, high-quality, and complete manner in accordance with the booking.
10.1.2. Be liable for the quality of services provided in accordance with applicable legislation.
10.2. The Hotel has the right to:
10.2.1. Receive timely payment for hotel services under this Agreement.
10.2.2. Require the Guest to compensate BANKHOTEL for any material damages caused by the Guest's actions or inaction, or those of the Guest's visitors or pet.
10.2.3. Retain all payments made in the event of a late cancellation or no-show.
10.2.4. Terminate the provision of hotel services without refund in the event that the Guest violates these Terms and Conditions, the Hotel Guest Rules of BANKHOTEL, or any other internal regulations published on the BANKHOTEL website and at the hotel reception.
11. LIABILITY
11.1. In the event of full or partial failure to fulfill obligations under this Agreement, the defaulting Party shall compensate the other Party for any resulting losses.
11.2. If BANKHOTEL is unable to provide the booked services, it shall, upon the Guest's request, arrange equivalent accommodation at another hotel in the same area.
11.3. If the Guest identifies deficiencies in the service provided, or a discrepancy between the service and the Hotel's category, the Guest may choose to demand:
- remedy of the deficiencies free of charge within a timeframe agreed by the parties;
- a proportional reduction in the price of the service.
BANKHOTEL must take corrective action within the timeframe agreed with the Guest. If BANKHOTEL fails to remedy the deficiencies within the agreed timeframe, the Guest has the right to terminate the Agreement and claim full compensation for losses in accordance with applicable legislation. Any amounts paid by the Guest shall be refunded on the day of termination, or by mutual agreement, but no later than 7 (seven) banking days from the date the relevant claim is submitted.
Claims and complaints submitted after the Guest's departure from the Hotel will not be considered.
BANKHOTEL shall not be liable for service deficiencies that are proven to have occurred through the fault of the Guest (or the Guest's visitors) or as a result of force majeure.
11.4. BANKHOTEL is liable for harm caused to the life, health, or property of the Guest arising from deficiencies in service provision, in accordance with applicable legislation of Ukraine. The extent and procedure for compensation shall be determined in accordance with applicable legislation.
11.5. BANKHOTEL shall not be liable for harm caused to the life, health, or property of the Guest arising from force majeure circumstances.
11.6. The Guest shall compensate BANKHOTEL for any losses caused by the Guest's loss of or damage to hotel property, in accordance with this Agreement and applicable legislation of Ukraine.
11.7. In the event of loss or damage to BANKHOTEL property caused by the Guest, the Guest's visitors, or the Guest's pet, the Guest must compensate the Hotel no later than the check-out date. The amount of compensation shall be determined based on the information displayed at the hotel reception, or, where such information is unavailable, at the market value of the lost or damaged property.
11.8. Guests and visitors are solely responsible for the safety of vehicles parked in the hotel's parking areas.
11.9. If a Guest repeatedly violates these Terms and Conditions, causing material losses or inconvenience to other guests, BANKHOTEL reserves the right, in addition to refusing check-in or terminating the Agreement, to add the Guest to the "Do Not Welcome" list.
The "Do Not Welcome" list is a register of guests who have breached hotel policies, containing identifying guest data, pursuant to which BANKHOTEL management may refuse future service to the individual concerned.
11.10. In the event of any overdue payment, the Guest shall pay a late fee of 3% (three percent) of the overdue amount for each day of delay.
12. AMENDMENTS
12.1. BANKHOTEL reserves the right to amend these Terms and Conditions unilaterally, in compliance with applicable legislation of Ukraine. Any amendments shall be published on the BANKHOTEL website and displayed at the hotel reception. Previously paid bookings shall not be affected by such amendments.
12.2. BANKHOTEL warrants that the version of these Terms and Conditions currently published on the BANKHOTEL website is the valid and effective version.
13. MISCELLANEOUS
13.1. These Terms and Conditions are made publicly available to all Guests by being published on the BANKHOTEL website and displayed at the hotel reception.
13.2. These Terms and Conditions are public in nature in accordance with Articles 633 and 641 of the Civil Code of Ukraine, and apply equally to all Guests.
13.3. Acceptance of these Terms and Conditions is full and unconditional, and signifies the Guest's agreement to all provisions herein without exception, as well as confirmation that the Guest understands the nature of their actions, that all terms are clear to them, and that the Guest is acting freely and without duress, deception, coercion, or undue influence.
13.3. By mutual agreement, the Parties may enter into a written agreement signed by both Parties.
13.4. By entering into this Agreement, the Guest grants consent to the collection and processing of their personal data for purposes related to the provision of hotel services, within the limits established by the legislation of Ukraine.
13.5. All disputes arising from or related to this Agreement shall be resolved through negotiations between the Parties. If a dispute cannot be resolved through negotiation, it shall be referred to a court of competent jurisdiction in accordance with applicable legislation.
13.6. BANKHOTEL is a corporate income tax payer under the general regime in accordance with the Tax Code of Ukraine.
